A bail can be requested when carrying out works and deliveries, and is imposed by a government department or a private individual.
The two main guarantees are:
- a bail in money
- a bail in solidarity
Please note that a guarantee for provisional release is a form of legal consignment, about which you can find more information here.
BAIL FOR PROVISIONAL RELEASE
The bail for the conditional release of a person detained is a form of judicial consignment, which allows him to be released on provisional payment of a deposit in cash, to be deposited with the Consignment and Deposit Office.
What is the role of the Consignment and Deposit Office in paying a bail for provisional release?
The bail for provisional exemption requested for the temporary release of a suspect must be deposited with the Consignment and Deposit Office.
To this end, the requested amount must be deposited into the account of the Consignment and Deposit Office, according to the payment instructions communicated by the Public Prosecution Service.
When will a bail for provisional release be released?
The fate of the deposit is usually determined in the final criminal decision (judgment or judgment).
Either the bail is released, after deduction of any costs and legal fines;
or the deposit forfeits to the Belgian State if procedural obligations are not met, or the person concerned withdraws from the execution of the sentence.
If the court has not determined the destination of the guarantee, the approval of the public prosecutor is necessary for the release.
